Hybrid people — determination of the status of persons who have undergone medical intervention using AI toolkit

Dear Colleagues and Friends, 

Since I am only an IT college student so I have not been involved in any serious project in the IT field. However, I hope that my student membership in AСM allows me to share my views with established professionals and thus join a broad and constructive discussion on AI issues. 

Over the past couple of years, the topic of harmonious development of technologies based on the fruits of AI has attracted everyone’s close attention. In an effort to understand the current stage of development of this technology and its perception by society and the government, I attended a lot of online events (including extremely enriching ACM Talks webinars), read dozens of articles in the professional and business press, studied regulations AI issues by EU, US and UN.

However, I do not see or feel that this collective search has harmonized the views on AI development expressed by inventors, representatives of the business community, IT specialists, and current and future users of AI products.

As a future IT professional, I would like to see less confrontation and more solidarity regarding the global technological breakthrough.

As an accomplished legal professional, I see that now is an important moment to move from honing the principles of working with AI to formulating and implementing (somewhat proactively) specific mechanisms for the implementation of AI products, as well as establishing fair and responsible regulation of their social and legal consequences. 

In the context of the above, I offer for consideration my views on two aspects of the development and implementation of AI technologies:

·                determination of the legal status of persons who have undergone medical intervention using AI toolkit — for the purpose of mutual protection of both a human from unfair influence on their central nervous system (to simplify — to protect against the “zombie factor”), and society from possible and predictable consequences similar effects on patients;

·                establishment of insurance funds for the solidarity participation of inventors, manufacturers, owners and users of AI toolkit — for the purpose of accelerating the practical implementation of this technology, ensuring its exponential growth.

Determination of the legal status of persons who have undergone medical intervention using AI toolkit 

In development of Principles on Symbiosis for Natural Life and Living AI (in particular, those proposed by Center for Long-term Artificial Intelligence, partly present in the basic regulations in the field of AI adopted by the EU, USA and UN), I would propose for consideration specification and development of the legal status of human whose central nervous system (voluntarily or for medical reasons or professional requirements) in any form (using any AI tools) is subjected to:

·                corrective action;

·                indirect or targeted management.

 To regulate the social and legal consequences of such an impact on the central nervous system of a person — both for the human himself and for those interacting with him in society — it is proposed to determine the legal status of these people as follows: 

§      human(s) with a hybrid structure of the nervous system (hybrid people) — persons (including patients, military personnel and other persons) whose central nervous system (voluntarily or for medical reasons or professional requirements) in any form (with the help of any AI tools) is subject to:

—                      corrective effects of AI tools;

—                      indirect or targeted management of AI tools.

 In this case, the goals of such influence (conscientious or malicious) do not matter — the very fact of influence on the central nervous system of a person or the risk/threat of such influence is important; 

·                zombie factor — a condition of a human with a hybrid structure of the nervous system (hybrid people), in which this person does not and/or cannot control his actions (thoughts, speech, muscle activity) and bear material and/or other responsibility for his actions committed in the state zombie factor, confirmed by a collegial expert opinion. 

Establishment of insurance funds for the solidarity participation of inventors, manufacturers, owners and users of AI toolkit 

To regulate the material and other legal consequences of the creation and implementation of AI tools aimed at influencing the human central nervous system, it is proposed to define the conditions for public offering, as well as non-commercial and commercial promotion of AI tools, as follows: 

§     practical implementation of AI tools — any use of AI tools (fair or malicious) for personal, professional, government or public purposes, both on a commercial and non-commercial basis; 

·                conditions for the practical implementation of AI tools — share (including by establishing or purchasing a policy) participation in the insurance fund for joint liability of inventors, manufacturers, owners and users of AI tools (including humans with a hybrid structure of the nervous system); 

·                insurance funds for the solidarity participation of inventors, vendors, owners and users of AI tools — liability insurance funds for inventors, manufacturers, owners and users of AI tools (including humans with a hybrid structure of the nervous system), established and operating in order to accelerate the implementation of AI technology, ensuring its exponential growth, as well as protecting people and society from the negative consequences of using AI tools. 

It appears that such an approach would serve the purpose of eliminating bias and discrimination, as well as facilitating the legal adaptation of both AI tools and humans with a hybrid nervous system structure. 

Of course, the proposals presented are only rough drafts of conceptual proposals for discussion by the professional community. Thank you again for the invitation and for your attention to my views.
